MOUNTAIN PEAK TOURS POLICIES

TERMS AND CONDITIONS:

  1. All drivers must be 18 years and over with a current Australian full motor vehicle drivers licence.

  2. Your four wheel drive must be mechanically sound, registered, roadworthy, insured and capable 4WD with high and low range. You will be responsible for all costs associated with that vehicle, including fuel, mechanical repairs and/or damage. Adequate insurance cover is a requirement of the trip, including travel, personal, motor vehicle and medical insurances.

  3. No responsibility will be accepted for the loss or damage to any personal property, repairs, or recovery costs.

  4. No responsibility will be accepted for loss or damage to personal effects, and the Operators of 'Mountain Peak Tours' will not be held liable for any illness, injury or damages caused by the participants whilst engaged on the trip.

  5. If the trip participants choose to conduct any activities outside of the tour itinerary, the Operators of 'Mountain Peak Tours' will not accept any responsibility for any matter arising from such activities.

  6. Your safety is our number one priority.  The tour may be subject to change due to severe weather or road conditions and/or any unforeseen road closures. Every effort will be made to ensure dates and times are met, however no guarantees will be made if there are delays or the dates and times are not kept.

  7. Your four wheel drive should be equipped with front and rear recovery points.  We suggest you having a basic recovery kit which includes a snatch strap and at least two rated shackles.   We can suggest some options if you need help on this.  The trip will primarily be on rough, unsealed roads through varying terrains which may include rocky tracks, gravel roads and tracks, mud, and creek and/or river crossings all of which will be varying in difficulty depending on the tour undertaken and weather conditions.  Some self sufficient 4WD experience is necessary to traverse these remote areas. You warrant that:

    1. The driver of your vehicle has sufficient driving experience and expertise to safely drive in those conditions and to maintain the pace of the trip; and

    2. Your vehicle can handle those conditions and able to be driven at the pace of the trip. 

    3. You will let your trip leader know if you are stepping outside your comfort zone in both vehicle and your own skill.

  8. If the tour is self catered, it is your responsibility to ensure you carry all food and drink requirements (including water), cooking and camping equipment and appropriate warm clothing as part of the trips will consist of multiple nights in a remote location.

  9. The trip participant agrees to follow all directions given to them by the Operators of 'Mountain Peak Tours' (unless such directions are unreasonable, unlawful or likely cause harm to self and or/others).  The Operators of 'Mountain Peak Tours' reserves the right to ask the trip participants to leave the trip as a result of unacceptable or abusive behaviour or any compromise to their own or another persons safety.

  10. Trip participants agree that four wheel driving is challenging and adventurous and as a result recognise and understand the inherent risks. Travel into remote areas will be a part of the trip and medical assistance may not always be on hand. However, the Operator of 'Mountain Peak Tours' holds a current First Aid Certificate and is Emergency Medical Responder qualified. The trip participants authorise the Operators of 'Mountain Peak Tours' to arrange the most appropriate form of medical assistance in the event medical attention is required. This assistance may include medical evacuation if necessary and any cost involved in the said assistance shall be born by the trip participant. You warrant that you do not have any pre-existing medical condition or disability which will impact on or prevent you from participating in or completing the trip. It is your responsibility to ensure that you are medically capable of completing the trip. Responsibility will not be accepted for failure to disclose any pre-existing medical conditions and the Operators of 'Mountain Peak Tours' will not be held liable in any way.

  11. The trip participants have the right to leave the trip at any time, provided it is safe to do so and the Operators of 'Mountain Peak Tours' accepts no responsibility once the decision to leave has been made. The trip participants acknowledge and agree that the trip and all associated activities are voluntary.

  12. The Operators of 'Mountain Peak Tours' shall make every attempt to ensure that the trip participants are sent all respective trip details and an itinerary upon confirmation of availability in regard to the times and dates chosen by the participant.

 

Liability

  1. You release the Operators of 'Mountain Peak Tours' from all Claims and liabilities arising out of or relating to your participation in the trip, including (but not limited to) actions (or inaction's) of the Operators of 'Mountain Peak Tours' undertaken pursuant to these terms, and including those caused or contributed to by third parties. For the purposes of this clause “Claims” means any allegation, cause of action, claim, demand, proceeding, litigation, investigation, judgement, loss, cost or expense of whatever nature and whether present or future, fixed or ascertained, actual or contingent and whether arising at law or in equity, under statute or otherwise.
